<br />(a) Placement. Monuments shall be set at each comer of the survey boundary of the <br />subdivision, and permanent lot markers shall be placed at each lot comer. Monuments and lot <br />markers shall be set immediately after completion of utility installations and street construction <br />or as the director of engineering public vvolks may require. <br /> <br />U. Sec. 110.092(d)(4)a.4 (variance from Edwards Aquifer regulations): <br /> <br />4. The planning and zoning commission may vary these requirements prior to or at <br />the time of subdivision approval, after receiving reports from the directors of <br />public works, water and wastewater. planning and development services and/or <br />en v ilOmnGnt and engineering. <br /> <br />V. Sec. 110.132: <br /> <br />Sec. 110.132. Bid tabulation sheet and construction contract requirements. <br /> <br />Before any subdivider is entitled to reimbursement of any funds, he shall furnish the director <br />of engineering city with a signed copy of the bid tabulation sheet accepted by the subdivider-him <br />for construction of the improvements for which the reimbursement is to be made, as well as a <br />copy of the construction contract between the subdivider and the contractor. <br /> <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be <br />unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance <br />will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 4. All ordinances and resolution or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br /> <br />SECTION 5. Any person violating any provision of this ordinance commits a misdemeanor <br />and is subj ect to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. <br /> <br />SECTION 6.
