Sec. 110.045(e)(3) (review of construction plans): <br /> <br />(3) The director of engineering publiG wOlks shall review the plat and construction plans for <br />the purpose of determining their conformity with this chapter and applicable city <br />standards, giving consideration to sound engineering practices and design criteria. The <br />director of planning and development services shall transmit the plat to the commission, <br />noting any objections to the plat and plans, if any, in a written memorandum to the <br />commISSIon. <br /> <br />Q. Sec. 1l0.045(f)(2). (g) and (h) (procedures prior to recording of subdivision plat): <br /> <br />(2) In addition to the performance required in subsection (f)(1) ofthis section, the subdivider <br />shall provide the following to the director of planning and development services pnblie <br />works: <br /> <br />a. Tax certificates. Tax certificates showing that no taxes are currently due or <br />delinquent against the property. <br /> <br />b. Waiver. An agreement waiving any claim for damages against the city and placing <br />responsibility for any damages occasioned by the alteration by the subdivider of the <br />surface of any portion of existing streets and alleys, in the following form: <br /> <br />City of San MMCOS <br />SMt MMC,05, Texas <br /> <br />In accordance with the City of San Marcos Subdivision Ordinance and in <br />consideration ofthe city's approval of Subdivision, owner waives any and <br />all claims for damages against the City of San Marcos, and accepts responsibility for <br />any damages occasioned by the establishment of grades or the alteration of the <br />surface of any portion of existing 'streets and alleys to conform to the grades <br />established in this subdivision. <br /> <br />(Owner signature) <br /> <br />c. Engineer's certificate. A certificate, signed by the subdivider's registered engineer, <br />that any and all improvements constructed in the subdivision have been completed <br />in accordance with the approved construction plans and that all monuments and lot <br />markers have been properly located and placed in accordance with this chapter, as <br />applicable. <br /> <br />d. A reproducible tracing and one copy of the final plat, together with one reproducible <br />set of construction plans, shall be delivered to the director of planning and <br />development services public' ~Olks. One reproducible set of as-built construction <br />plans is required if completion of construction improvements precedes recordation <br />of the final plat. In all cases a reproducible set of as-built construction plans is <br />required. <br /> <br />e. The subdivider shall provide the city with sufficient evidence that he holds fee simple <br />title to the property being subdivided. <br /> <br />f. The subdivider shall provide dedication of all streets, alleys, parks, easements and <br />other land intended for public use, signed by the owner and by all other persons <br />owning an interest in the property subdivided and platted, which shall be <br />acknowledged in the manner prescribed by state laws for conveyance of real property <br />and shall be submitted and attached to or placed in the final plat in accordance with <br />subsection (b) ( 5)h of this section. <br /> <br />g.
