<br />19. <br /> <br />RESOLUTION 1999 - 171R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS APPROVING A <br />REVISED LICENSE AGREEMENT BETWEEN THE <br />CITY AND CADE AND BETH JACKSON FOR THE <br />USE OF A PORTION OF DELMAR STREET FOR THE <br />PURPOSE OF PROVIDING DRIVEWAY ACCESS; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE <br />THE LICENSE AGREEMENT; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. Cade and Beth Jackson own Lot 240, Z. Williamson Third Addition and the <br />property is located between Delmar Street and Cylde Street, approximately 100 feet from <br />Girard Street. <br /> <br />2. In August, 1998, the Council approved a License Agreement for the Jacksons' to <br />pave a portion of the undeveloped portion of the right-of-way of Delmar Street, between <br />Girard Street and Furman Street, for the purpose of providing driveway access to their <br />property. <br /> <br />3. The Jacksons' requested and received approval of a variance to the paving <br />requirement from the City's Zoning Board of Adjustments. <br /> <br />4. The attached revised License Agreement eliminates the requirement that the <br />driveway be paved. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The attached revised License Agreement between the City and Cade <br />and Beth Jackson is approved. <br /> <br />PART 2. The City Manager, Larry D. Gilley, is authorized to execute the <br />License Agreement. <br /> <br />PART 3. <br />its passage. <br /> <br />That this Resolution shall be in full force and effect from and after <br /> <br />ADOPTED this 13th <br /> <br />day of September <br /> <br />1999. <br /> <br />fJ~~ ~ <br /> <br />Billy G.
