<br />30. <br /> <br />TELECOMMUNICATIONS LICENSE AGREEMENT <br /> <br />DATE: September 14, 1999 <br /> <br />LICENSOR: City of San Marcos, a municipal corporation <br />630 East Hopkins Street <br />San Marcos, Hays County, Texas 78666 <br /> <br />LICENSEE: Worldcom Network Services, Inc. <br />2400 N. Glenville Drive <br />Richardson, TX 75082 <br /> <br />CONSIDERATION: $100 per year, payable upon execution of this Agreement and annually thereafter <br />on each anniversary of this Agreement, and other good and valuable consideration, including the Licensee's <br />performance of its obligations under this agreement. <br /> <br />LICENSE AREA: A strip of property five feet in width, centered on the line described as "Proposed <br />WorldCom Cable"on the map attached to this Agreement as Exhibit A, in the River Ridge Subdivision, a <br />subdivision described on the map or plat recorded in Volume 4, Pages 212-218 of the Hays County Plat <br />Records. <br /> <br />RECITALS <br /> <br />A. The Licensee desires to use the License Area for the installation and maintenance of a single fiber <br />optic telecommunications cable and related facilities (the "Facilities") to connect the Thrifty Call, Inc. site <br />at 401 Carlson Circle, San Marcos, Texas, to the Licensee's telecommunications facilities within the nearby <br />Union Pacific Railroad right-of-way. <br /> <br />B. The Licensor is willing to grant the Licensee a license to install the Facilities within the License <br />Area under the terms and conditions contained in this Agreement. <br /> <br />GRANT OF LICENSE; TERM,8 AND CONDITIONS <br /> <br />NOW THEREFORE, the Licensor, for the consideration, grants and demises to the Licensee a non- <br />exclusive license to install, operate, and maintain the Facilities across and within the License Area, subject <br />to the following terms and conditions: <br /> <br />1. The Licensee agrees to obtain the Licensor's prior written approval for the Licensee's <br />construction or reconstruction activities within the License Area, such approval not to be unreasonably <br />withheld. This approval may be in the form of a City right-of-way construction permit. The Licensee agrees <br />to maintain safe and proper clearances from all other utility facilities within or upon the License Area at all <br />times during construction activities. <br /> <br />2. The Licensee agrees to comply with all federal, state and local laws, construction and safety <br />codes, and other regulations in the construction and maintenance of the Facilities within the License Area. <br /> <br />3. The Licensee agrees to maintain the Facilities with due regard for the public safety and <br />convenience, and will promptly remove any hazards created by storms, accidents, vandalism or other causes. <br />
