ORDINANCE 1999- RECITALS: 1. The City Council adopted an ordinance on September 14, 1998 that amended the table of police officer positions maintained under City Code Section 2.373, and eliminated the position of corporal within the Police Department. 2. The City Council adopted an ordinance on September 13, 1999 that amended the table of police officer positions maintained under City Code Section 2.373, and did not include the position of corporal within the Police Department. 3. The City Council wishes to amend the table of police officer positions maintained under City Code Section 2.373 in order to restore the position of corporal within the Police Department. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The table of positions for each Civil Service Classification in the Police and Fire Departments kept on file in the City Secretary's office is amended in accordance with Section 2.373 of the City Code and Section 143.021 of the Texas Local Government Code to read as follows: Classification Number of Positions POLICE DEPARTMENT Police Officer (including trainees) 43 Police Corporal 15 Police Sergeant 11 Police Commander 5 Police Assistant Director 2 FIRE DEPARTMENT Fire Fighters (including trainees) 9 Driver/Engineer 12 Fire Lieutenant 6 Fire Captain 3 Assistant Fire Chief 1 SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 4. The importance of this Ordinance creates an emergency and an imperative public necessity, and the provisions of the Charter requiring that ordinances be presented at three separate meetings, and that ordinances do not take effect until ten (10) days after the date of final passage are suspended, and this Ordinance will take effect upon publication of notice of its adoption in a newspaper of general circulation in the City.
