Section 18.090 of the City Code authorizes the City Council to set the amounts of fees <br />charged by the Environmental Health Department related to food service establishments. <br /> <br />2. The City Council wishes to amend this City Code section to provide for the payment of <br />fees to the Environmental Health Department, and to increase the amounts of the fees, in <br />order to recover more of the City's costs in providing the services to the public. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. Section 18.090(c) of the City Code is amended as follows (underlining <br />indicates added text and overstrike indicates deleted text): <br /> <br />(c) Fees. <br /> <br />(1) The applicant for a permit under this division shall pay all fees to the city <br />department of environmental health tax assessor-collector. <br /> <br />(2) Fees for food service establishment permits are established by the city <br />council. <br /> <br />SECTION 2. The following fees are set for food service establishments under Section <br />18.090 of the City Code: <br /> <br />Food service permit-small user (0-5 employees) <br />Food service permit-medium user (6-15 employees) <br />Food service permit-large user (over15 employees) <br />Food handler training certificates <br /> <br />$1 OO/year <br />$175/year <br />$250/year <br />$10/card (2-year duration) <br /> <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions <br />of this ordinance will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 4. All ordinances and resolution or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br /> <br />SECTION 5. Any person violating any provision of this ordinance commits a misdemeanor <br />and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon <br />conviction. <br /> <br />SECTION 6. This Ordinance will take effect 10 days after the date of its final passage, and <br />the City Secretary will publish notice of its adoption in a newspaper of general circulation <br />in the City. <br /> <br />PASSED AND APPROVED on first reading September 7, 1999. <br />PASSED AND APPROVED on second reading September 13, 1999. <br />PASSED APPROVED AND ADOPTED September 27, 1999. <br />, <br />
