ORDINANCE 1999- 81 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 18.090 OF THE CITY CODE REGARDING FEES CHARGED BY THE ENVIRONMENTAL HEALTH DEPARTMENT; INCREASING THE AMOUNTS OF VARIOUS FEES FOR FOOD SERVICE ESTABLISHMENTS; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. RECITALS: 1. Section 18.090 of the City Code authorizes the City Council to set the amounts of fees charged by the Environmental Health Department related to food service establishments. 2. The City Council wishes to amend this City Code section to provide for the payment of fees to the Environmental Health Department, and to increase the amounts of the fees, in order to recover more of the City's costs in providing the services to the public. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. Section 18.090(c) of the City Code is amended as follows (underlining indicates added text and overstrike indicates deleted text): (c) Fees. (1) The applicant for a permit under this division shall pay all fees to the city department of environmental health tax assessor-collector. (2) Fees for food service establishment permits are established by the city council. SECTION 2. The following fees are set for food service establishments under Section 18.090 of the City Code: Food service permit-small user (0-5 employees) Food service permit-medium user (6-15 employees) Food service permit-large user (over15 employees) Food handler training certificates $1 OO/year $175/year $250/year $10/card (2-year duration) SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 4. All ordinances and resolution or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 5. Any person violating any provision of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 6. This Ordinance will take effect 10 days after the date of its final passage, and the City Secretary will publish notice of its adoption in a newspaper of general circulation in the City.
