U....~'"o 0 ~ Ii <br />I_J 0... <br />Ili1n LY <br />'~Br (,/) <br />,g) <br /> <br />ORDINANCE 1999- 82 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING SECTION 58.127 OF <br />THE CITY CODE TO PROVIDE FOR OVERDUE FEES; AND <br />SETTING AND INCREASING THE AMOUNTS OF VARIOUS <br />LIBRARY-RELATED FEES; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. Section 58.127 of the City Code authorizes the City Council to set the amounts of fees <br />related to services provided by the San Marcos Public Library. <br /> <br />2. The Library Board has recommended the charging of fees for overdue materials, and <br />certain increases in the amounts of other fees for library-related services, in order to <br />recover more of the City's costs in providing the services to the public. <br /> <br />3. The City Council wishes to amend this City Code section to authorize the charging of <br />fees for overdue materials, to authorize the library director to set certain incidental fees, <br />and to increase the amounts of other fees for library-related services. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. Section 58.127 of the City Code is amended as follows (underlining indicates <br />added text; overstrike indicates deleted text): <br /> <br />Sec. 58.127. Fees and charges for library services. <br /> <br />(a) Use of the library shall be free of charge to all persons who reside in or own <br />property in the city, subject only to the fees and charges specifically authorized by this <br />division. <br /> <br />(b) Persons who reside outside the city may use the library upon paying a fee <br />established by the city council. <br /> <br />(c) Entities such as the counties y, school district~ or Gary Job Corps may enter into <br />agreements with the city in order to allow their constituents who reside outside the city to <br />use the city library without a user fee. <br /> <br />(d) In order to borrow library materials or equipment or to use library equipment in <br />the library, users must obtain and present a library card. The initial library card is free of <br />charge. A fee established by the city council 'vViII be charged for replacement cards. <br /> <br />(e) Charges for damaged, but repairable, library material or equipment shall be <br />based on the cost of repairing the damaged item as determined by the library director. <br /> <br />(f) Charges for lost or irreparably damaged library material or equipment shall <br />include the replacement cost of the item, as determined by the library director, plus a <br />handling fee established by the city council. <br /> <br />(g) Overdue fees A late charge established by the city council will be charged for <br />materials and audiovisual equipment that are is not returned on or before the established <br />due date and time. Payment of an overdue fee will not bar prosecution of a person under <br />Section 58.126 of this Code. <br /> <br />(h) The library director may. with the approval of the library board. set incidental fees <br />for postage and materials used to provide library services. Examples of such fees are <br />interlibrary loan and reserve book postage fees. replacement card fees, and fees for <br />photocopies. microfilm prints. and computer copies. <br /> <br />SECTION 2. The following fees are set for library-related services under Section 58.127 <br />
