The City Council desires to improve the City of San Marcos <br />Municipal Court and to that end, establishes a Technology Fee to finance the purchase of <br />technological enhancements for the Court. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That Chapter 2 - Administration, Article 7, Division 1, of the San Marcos <br />City Code is amended by adding Section 2.543 and 2.544 to read as follows (underlining indicates <br />added language; an oveIstJike indicates deleted language): <br /> <br />Sec. 2.543. Municipal Court Technology Fee. <br /> <br />(a) The city council establishes a municipal court technology fee. The amount of the fee will <br />be established by the council by separate ordinance. <br /> <br />(b) The fee will be assessed and collected from a defendant upon conviction for a <br />misdemeanor offense in the municipal court as a cost of court. A defendant is considered convicted <br />if: <br /> <br />ill A sentence is imposed on the person: <br />m The person is placed on community supervision. including deferred adjudication <br />community supervision: or <br />m The court defers final disposition of the person's case. <br /> <br />( c) The clerk of the court shall collect the fee and pay the fee to the director of finance. who <br />shall deposit the fee into the Municipal Court Technology Fund. <br /> <br />Sec. 2.544. Designated Use of the Fees and Administration. <br /> <br />The fees collected under Section 2.543 shall be used only to finance the purchase of <br />technological enhancements for the city's municipal court. including: <br /> <br />.Q.l Computer systems: <br />at Computer networks: <br />ill Computer hardware: <br />!1L Computer software: <br />in.
