Subchapter C, Chapter 402 of the Local Government Code authorizes the creation and <br />operation of municipal drainage utilities. <br /> <br />2. On July 12, 1999, the City Council established by ordinance, the City of San Marcos <br />Drainage Utility. <br /> <br />3. A public hearing on the establishment of drainage utility rates was held on <br />, after publication ofthe proposed ordinance in the San Marcos Daily Record <br />on July 23, 1999, August 8, 1999, and Au~ust 20. 1999 <br /> <br />4. After the close of the public hearing the City Council finds that the City will establish a <br />schedule of drainage charges against all real property in the proposed service area of the City's <br />drainage utility. <br /> <br />5. The City Council finds that the City will provide drainage for all real property in the <br />proposed service area on payment of the drainage charges, except for real property exempted from <br />the charges. <br /> <br />6. The City Council finds that the City will offer drainage service on nondiscriminatory, <br />reasonable, and equitable terms. <br /> <br />7. The City Council finds that the drainage charges are nondiscriminatory, reasonable and <br />equitable and will provide for the creation, operation, planning, engineering, inspection, construction, <br />repair, maintenance, improvement, reconstructio~and administration of the drainage utility. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. One Equivalent Residential Unit (ERU) for commercial land uses for <br />purposes of the Drainage Utility is determined to be 2,250 square feet of impervious cover. <br /> <br />SECTION 2. Four categories ofland use for calculation of drainage charges are established <br />as follows: (1) Commercial, (2) Residential - Small lot, (3) Residential - Average lot, and (4) <br />Residential - Large lot. <br /> <br />SECTION 3. ERUs for residential lots are classified by lot size as follows: <br /> <br />Residential - Small lot <br />Residential- Average lot <br />Residential - Large lot <br /> <br />o - 6000 square feet. <br />6,001 - 12,000 square feet. <br />Greater than 12,000 square feet. <br /> <br />SECTION 4. Drainage charges for each category ofland use under the City of San Marcos <br />Drainage Utility are set as follows: <br /> <br />Commercial <br />Residential - Small lot <br />Residential- Average lot <br />Residential - Large lot <br /> <br />$3.21 per equivalent residential unit (ERU) per month. <br />$2.00 per month. <br />$3.21 per month. <br />$3.67 per month. <br /> <br />The number of ERU' s for each Commercial property is determined by dividing the square footage <br /> <br />1999-07-21 DRAINRATE.ORD.wpd <br />
