89. AMENDMENT NUMBER THREE TO LEASE OF REAL PROPERTY BETWEEN SAN MARCOS AREA CHAMBER OF COMMERCE AND THE CITY OF SAN MARCOS, TEXAS STATE OF TEXAS s s s COUNTY OF HAYS The City of San Marcos, Texas (the "City") and the San Marcos Area Chamber of Commerce (the "Chamber") agree to amend their Lease Agreement (the "Lease") entered into on November 9, 1977. The Lease was previously amended by a Lease Amendment and Addendum dated April 3, 1978, and by a Second Lease Amendment and Addendum dated June 12,1978. 1. The City and the Chamber agree to amend the description of the leased premises contained in the first page of the Lease to read as follows: The leased premises consists of the 24,059 square foot, more or less, tract of land described on the attached Exhibit A, which is incorporated in this Lease for all purposes. 2. The City and the Chamber agree to amend Part II of the Lease to read as follows: As rental for the leased premises, Chamber will pay to City the sum of $10.00. As further consideration for this Lease, the Chamber agrees to construct an addition and expansion to the existing building on the leased premises for the Chamber's operation as a Chamber of Commerce and tourism information office. 3. In all other respects, except as modified, the terms and provisions of the Lease shall remain in full force and effect. This amendment shall have the same force and effect as if incorporated in the original lease. 4. The City, in consideration of the public benefits to the San Marcos community from the services provided by the Chamber through the Chamber's use of the leased premises since the inception of the Lease, agrees to waive and release the Chamber from payment of rentals under the Lease as those rentals were defined before the effective date of this amendment.
