<br />92. <br /> <br />RESOLUTION 1999-20.2-R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS APPROVING AMENDMENT NO.1 TO <br />THE AGREEMENT WITH BROWNING-FERRIS, INC. TO <br />INCREASE RATES FOR COLLECTION AND DISPOSAL OF <br />RESIDENTIAL SOLID WASTE AND RECYCLABLE <br />MATERIALS; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE THE AMENDMENT; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City entered into an agreement (the "Agreement") with Browning-Ferris, Inc. ("BFI") on July <br />29, 1997, for residential solid waste and recyclable materials collection and disposal services. <br /> <br />2. The Agreement provides for rate adjustments based on changes in the consumer price index. <br /> <br />3. An increase in the rates of2.14% is justified on the basis of changes in the consumer price index. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />P ART 1. The attached Amendment No. 1 to the Agreement to increase the rates for services under <br />the Agreement by 2.14% is approved. <br /> <br />PART 2. The City Manager, Larry D. Gilley, is authorized to execute the attached amendment on <br />behalf of the City of San Marcos. <br /> <br />PART 3.
