LLlO) <br />, CI:I_ <br />',' ;:>.Q <br />ILJ;,{ 5 & <br /> <br />107 <br /> <br />ORDINANCE 1999- 87 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br />MAP OF THE CITY BY ZONING A 1.464 ACRE TRACT OF <br />UNZONED PROPERTY LOCATED AT 1625 POST ROAD AS <br />"MF-4" MULTI-FAMILY DWELLING DISTRICT (HIGH <br />DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. On September 14,1999, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to assign "MF-4" Multi-Family Dwelling <br />District (High Density) zoning for a 1.464 acre tract of property located at 1625 Post Road. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on September 14, 1999 consider and vote to approve the request, and <br />has recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 2 'itn <br />October , 1999, regarding the request. <br /> <br />day of <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br />of the San Marcos City Code, is amended to rezone the following real property which is <br />presently unzoned to "MF-4" Multi-Family Dwelling District (High Density): <br /> <br />Street address: <br /> <br />1625 Post Road <br /> <br />Size: 1.464 acres. <br /> <br />Leaal description: See the metes and bounds description of which is attached as <br />Exhibit A. <br /> <br />Deed or plat reference: Volume 1213, page 510, Hays County Official Records. <br /> <br />SECTION 2. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 3. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br />in a newspaper of general circulation in the City. This ordinance will take effect upon <br />publication of this notice. <br /> <br />PASSED, APPROVED AND ADOPTED this 2St!day of October , 1999, <br />subject to reconsideration at the next regular City Council meeting scheduled for <br />November 8, 1999. <br /> <br />Reconsidered yes no x <br />
