U~ ORDINANCE 1999----S.S AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 1.84 ACRE TRACT OF PROPERTY LOCATED IN THE 2200 BLOCK OF INTERSTATE HIGHWAY 35 SOUTH FROM "I" INDUSTRIAL DISTRICT TO "C" COMMERCIAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENAL TIES. RECITALS: 1. On September 14, 1999, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "I" Industrial District to "C" Commercial District for a 1.84 acre tract of property located in the 2200 Block of Interstate Highway 35 South. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on September 14, 1999 consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the October , 1999, regarding the request. 2')th day of 4. All requirements of Chapter 114, Zoning, ofthe San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the following real property which is presently zoned "I" Industrial District to "C" Commercial District: Street address: 2200 Block of Interstate Highway 35 South Size: 1.84 acres. Legal description: Lots 1 and 2 of the Warren Properties Subdivision. Deed or plat reference: Volume 2, page 267, Plat Records of Hays County, Texas.. SECTION 2. The Future Land Use Plan of the San Marcos Horizons City Master Plan is revised to conform to this zoning map amendment. SECTION 3. Any person violating any provision of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 4. After its original passage, this ordinance will be subject to reconsideration at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is reconsidered and approved, notice of its adoption will be published in a newspaper of general circulation in the City. This ordinance will take effect upon publication of this notice. PASSED, APPROVED AND ADOPTED this 25thdayof October ,1999, subject to reconsideration at the next regular City Council meeting scheduled for November 8, 1999.
