<br />118 <br /> <br />INTERLOCAL CONTRACT FOR COMPAQ SERVICES <br /> <br />THIS INTERLOCAL CONTRACT is entered into by and between the parties <br />shown below as Contracting Parties, pursuant to the authority granted and in compliance <br />with the provisions of the Interlocal Cooperation Act, Sections 791.001 et seq., <br />Government Code. <br /> <br />I. CONTRACTING PARTIES: <br /> <br />The Performing Agency: DEPARTMENT OF INFORMATION RESOURCES <br /> <br />The Receiving Party: CITY OF SAN MARCOS <br /> <br />II. STATEMENT OF SERVICES TO BE PERFORMED: <br /> <br />The Performing Agency has a Customer Services Master Agreement (Master <br />Agreement) with Compaq Computer Corporation (Compaq) for the period <br />September 1, 1999 through August 31, 2004 covering discounted Compaq <br />standard hardware product services and software product services. Receiving <br />Party's purchase of services under this Interlocal Contract must comply with the <br />terms of the Master Agreement. The Master Agreement may be accessed at <br />http://www.dir.state.tx.us/busops/contractservices/servicecontracts/compaq.htm <br /> <br />The services available are listed in Addendum B: Services Descriptions, to the <br />Master Agreement. Services currently available to the Receiving Party under the <br />terms ofthe Master Agreement include Bronze Support, Bronze Support for <br />Windows NT, Client Services Support Card, DECsystem/Basic System Support, <br />DECserviceIBasic Service, DECservice Node Service, Education Software <br />Library Service, Gold Support for Network Products, Gold Software Service for <br />Windows NT, Gold Support, Help Desk PRO and Premium Support, New <br />Version License Service, Microsoft Authorized Support, On-Site Hardware <br />Repair Service, Platinum Support, Prior Version Support, Silver Support, Silver <br />Software Service for Windows NT, Software Node Service, Software Product <br />Telephone Support, Software Update Distribution, System Management Support <br />Services, and User Application Support. Ifnew services are added to the Master <br />Agreement, Receiving Party may purchase those services under the terms of the <br />Master Agreement. <br /> <br />Generally, software services are available only when accompanied by hardware <br />services for the equipment the software services are servicing. An exception <br />exists for personal computer desktop/workstation software services where <br />hardware services is not required for the personal computer. Software services <br />only services agreement are not available under this Interlocal Contract. <br /> <br />To acquire services through this Interlocal Contract, Receiving Party must submit <br />to Performing Agency copies of 1) this Interlocal Contract; 2) Receiving Party's <br />
