<br />143 <br /> <br />RESOLUTION 1999- 217R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS APPROVING AN EXTENSION OF <br />THE CITY'S WASTEWATER SYSTEM TO SERVE THE SAC- <br />N-PAC STORE AT HIGHWAY 123 AND REDWOOD ROAD; <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. City Code Section 86.003(c) requires City Council approval for the extension of <br />City water or wastewater mains to serve uses outside the City limits. <br /> <br />2. Sac-N-Pac Stores, Inc. (the "Owner") has requested permission to extend a City <br />wastewater main to serve its property at Highway 123 and Redwood Road (the "Property"), <br />which is outside the city limits. <br /> <br />3. This wastewater main extension appears to be feasible and is to be constructed <br />at the sole expense of the Owner. <br /> <br />4. The Owner has submitted a written request for annexation of the Property by the <br /> <br />City. <br /> <br />5. City Code Section 86.003(d) requires use of the City water system by a person <br />who wishes to extend and connect to the City wastewater system. The Property is <br />currently served by Crystal Clear Water Supply Corporation, and the City has no water <br />mains in proximity to the Property, so the Owner has requested a variance from this <br />requirement. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. An extension of the City's wastewater system to serve the Property, to be <br />constructed at the sole expense of the Owner, and on the basis of the Owner's request for <br />annexation of the Property, is approved. <br /> <br />PART 2. A variance from City Code Section 86.003(d) is granted to the Owner to <br />allow the use of a water supply other than the City for the Property. <br /> <br />PART 3.
