<br /> <br />147 <br /> <br />Office of the City Manager <br /> <br />November 8, 1999 <br /> <br />Dr. Jerome Supple, President <br />Southwest Texas State University <br />601 University Drive <br />San Marcos, TX 78666 <br /> <br />Re: Memorandum of Understanding <br />City of San Marcos "Cut and Cap" Project <br /> <br />Dear Dr. Supple: <br /> <br />The City and SWT have been working for several months to coordinate the City's "Cut and Cap" <br />proj ect (the "Proj ect"), under which connections between the City's water system and the SWT water <br />system have been identified, along with City water main segments that can be abandoned and <br />transferred by the City to SWT. The City has developed construction plans for the Project and has <br />obtained the approval ofSWT Assistant Director of Utility Management Enos Jones for the plans. <br />A summary of the Project is contained in the attached memo from Laurie Anderson dated October <br />18, 1999. This letter, upon your countersignature below, will be a memorandum of understanding <br />between the City and SWT regarding the Project. <br /> <br />City Responsibilities <br />The City will bear all construction costs related to the Project. We anticipate that the Project will <br />be performed by DuMor Enterprises (the "Contractor") as a change order to the City's Northwest <br />Water System Improvements Project, which is presently underway. Our current estimate of the cost <br />of the Project is $135,850. Work on the project will begin on or about November 15, 1999 and the <br />Project is estimated to tal(e approximately 90 days to complete. The City will direct the Contractor <br />to provide advance notice to SWT of its work activities and schedule, including any necessary lane <br />or street closures and possible interruptions to water service. The City will direct the Contractor to <br />conduct its '.)vork activities so as to interfere as little as possible '.',lith SvVT's operations. The City <br />will cooperate with SWT to identify utility easements that can be released as a result of the Project. <br /> <br />Upon completion of the Project, the City will transfer title to SWT for the water main segments to <br />be abandoned by executing a bill of sale to SWT, and the City will release any utility easements on <br />SWT property that relate to the abandoned segments. <br /> <br />SWT Responsibilities <br />SWT will provide coordination and assistance to the Contractor to ensure that the Contractor's work <br />activities can be performed in an efficient manner and in a manner that minimizes interference with <br />SWT's operations. Enos Jones is designated as SWT's representative. for this purpose.
