<br />'II"'''' <br />_:.J,,_ <br /> <br />STATE USE CONTRACT <br /> <br />THIS CONTRACT is entered into by and between the Receiving Party and the <br />Performing Party (Assigned Sheltered Work Center) pursuant to the authority granted in <br />compliance with the provisions of Chapter 122, Human Resources Code, and certified by <br />Texas Industries for the Blind and Handicapped (TIBH) as a contract in compliance with <br />the provisions of Chapter 122, Human Resources Code. <br /> <br />AGREEMENT <br /> <br />In consideration of the premises and of the mutual covenants and agreements of <br />the parties hereto to be by them respectively kept and performed as hereinafter set forth, <br />it is agreed as follows: <br /> <br />Article 1. CONTRACTING PARTIES <br /> <br />Receiving Party: City of San Marcos, Texas <br />Performing Party: Capital Area Easter Seal Society <br /> <br />Article 2. CONTRACT PERIOD <br /> <br />This agreement shall be effective beginning on the 8th day of November, 1999, and <br />shall end on the 30th day of September, 2000. <br /> <br />Article 3. SERVICES TO BE PERFORMED <br /> <br />The statement of services to be performed under this contract is as follows: <br />Removal of vegetation and debris from right-of-ways, vacant land, alleyways and a pond <br />on a 12 cycle per year basis with the intent that each cycle corresponds to one cut for <br />every 30 day interval. Creek vegetation will be cut four times during a calendar year. In <br />those areas that require the use of a mower, the height of the blades will be set at a <br />minimum of 2 inches. For those areas requiring the use of weed-eaters the performing <br />party will strive to maintain a uniform height of 2 inches. These services are to be <br />performed in right-of-ways, alleyways, vacant land and a pond as identified by the <br />Performing Party in its Proposal (Attachment A). The Performing Party will perform all <br />services in accordance with the descriptions contained in Attachment A. <br /> <br />Article 4. CONTRACT AMOUNT <br /> <br />The total amount of this contract shall not exceed the sum of Two Hundred and <br />Eighteen Thousand, One Hundred and Thirty-Nine Dollars and 61/100 ($218,139.61). <br /> <br />1 <br />
