<br />186. <br /> <br />SPECIAL WARRANTY DEED <br /> <br />Date: <br /> <br />Grantor: <br /> <br />City of San Marcos, a municipal corporation <br /> <br />Grantor's Mailing Address: 630 East Hopkins Street, San Marcos, Hays County, Texas 78666 <br /> <br />Grantee: <br /> <br />Kathleen Teer Scott <br /> <br />Grantee's Mailing Address: 1312 Academy Street, San Marcos, Hays County, Texas 78666 <br /> <br />Consideration: Ten dollars ($10.00) and other good and valuable consideration, including Grantee's <br />agreement of release described in this deed, the receipt and sufficiency of which is acknowledged. <br /> <br />Property: <br /> <br />A 1,280 square foot tract of land being a portion of Lot 1, Block 1 of the G.A. McNaughton's <br />First Addition, as recorded in Volume 55, Page 593 of the Hays County Deed Records, said <br />tract being a portion of real property conveyed by Henry C. Kyle to the City of San Marcos, <br />as recorded in Volume 167, Page 307 of the Hays County deed Records, as more <br />particularly described by metes and bounds in Exhibit "An. <br /> <br />Reservations from and Exceptions to Conveyance and Warranty: Easements, rights-of-way, and <br />prescriptive rights, whether of record or not, all presently recorded restrictions, covenants, conditions, and <br />other instruments, other than liens and conveyances, that affect the property; any discrepancies, conflicts, <br />or shortages in area or boundary lines; and any encroachments or overlapping of improvements. <br /> <br />Grantor, for the consideration and subject to the reservations from and exceptions to conveyance and <br />warranty, grants, sells and conveys to Grantee the Property, together with all and singular the rights and <br />appurtenances in any wise thereto belonging, to have and hold it to Grantee, Grantee's heirs, executors, <br />administrators, successors or assigns forever. Grantor binds Grantor and Grantor's successors and assigns <br />to warrant and forever defend all and singular the Property to Grantee and Grantee's heirs, executors, <br />administrators, successors and assigns against every person whomsoever lawfully claiming or to claim the <br />same or any part, when the claim is by, through or under Grantor, but not otherwise. <br /> <br />Grantee, in accepting this deed and in consideration of this conveyance, agrees to release any claims she <br />may have against Grantor with respect to the portion of Lot 2, Block 1 of the G.A. McNaughton's First <br />Addition occupied by Grantor for right-of-way for Academy Street; and Grantee conveys to Grantor all of her <br />right, title, and interest in and to such portion of Lot 2, Block 1 of the G.A.
