<br />That the CalTex Holdings, Inc., a Texas corporation, 3312 Barker Hollow Pass, Austin, Travis
<br />County, Texas 78749, hereinafter called "Grantor," for and in consideration of the sum of Ten
<br />and No/lOO Dollars ($10.00), together with other good and valuable consideration, to Grantor
<br />cash in hand paid by the City of San Marcos, Texas, a Texas municipal corporation, 630 East
<br />Hopkins Street, San Marcos, Hays County, Texas 78666, hereinafter called "Grantee", the
<br />receipt of which is hereby acknowledged, has GRANTED, SOLD and CONVEYED, and by
<br />these presents does GRANT, SELL and CONVEY unto the said Grantee all those certain lots,
<br />tracts or parcels of land known and described as follows:

<br />Tract 1. Being 7.19 acres of land, more or less, out of the T.J. Chambers
<br />Survey, A-2. in Hays County, Texas, and being more particularly described in
<br />Exhibit "A" attached hereto and incorporated herein for all purposes;
<br />
<br />Tract 2. Being 5.46 acres of land out of the T.J. Chambers League in Hays
<br />County, Texas, and being more particularly described in Exhibit "B" attached
<br />hereto and incorporated herein for all purposes;
<br />
<br />Tract 3. Being 8.30 acres of land out of the T.J. Chambers League in Hays
<br />County, Texas, and being more particularly described in Exhibit "C" attached
<br />hereto and incorporated herein for all purposes;
<br />
<br />(such three tracts of land being collectively referred to hereinafter as the "Land") together with
<br />(i) all improvements located thereon; (ii) all right, title and interest of Grantor in and to any land
<br />lying in the bed of any alley, street, road or access way, open or proposed, in front of, at a side
<br />of, or adjoining the Land to the centerline thereof; (iii) all mineral rights and interests of Grantor
<br />relating to the Land (present or reversionary); (iv) all rights, privileges, and easements
<br />appurtenant to the Land, which are owned by Grantor, including without limitation, all
<br />development rights, air rights, water, water rights and water stock relating to the Land and any
<br />other easements, rights-of-way, or appurtenances used in connection with the beneficial use and
<br />enjoyment of the Land, including, without limitation, any and all rights of ingress and egress
<br />to and from the Land and any of Grantor's right to use same; and (v) any and all reversionary
<br />interests in and to the Land (the Land and all of the related improvements, appurtenances, rights
<br />and interests referenced in items (i) through (v) above are collectively referred to herein as the
<br />"Property") .

<br />This conveyance is expressly made subject to the restnctlons, - covenants, conditions,
<br />limitations, easements and reservations, if any, apparent on the ground, and easements, if any,
