<br />Description of 7 .19 acres, more or less, of land area in the T . J. Chambers Survey, Abstract No.
<br />2, City of San Marcos, Hays County, Texas, and being all of that Lot 39 and Lot 40, Tarod
<br />Philip Townhomes, Section 1, as recorded in Volume 3, Page 5, Hays County Plat Records, and
<br />the remaining portion of that tract described in a deed from William Z. Fitzgerald, Trustee to
<br />Chester Witte et al dated July 1, 1986 and recorded in Volume 610, page 262 of the Hays
<br />County Real Property Records, and being more particularly described by metes and bound as
<br />follows:

<br />BEGINNING at a 5/8" iron rod found in concrete for the occupied northeast line of the that tract
<br />described as 9.5 acres in a deed from Andrew Gary, Substitute Trustee to the Estate of John Cox
<br />dated July 6, 1990 and recorded in Volume 836, Page 295 of the Hays County Official Public
<br />Records, for the west comer of Ridgewood Street (a roadway of varying width shown on the
<br />plat of Tarod Philip Townhomes, Section 1) and the south comer of Witte remaining portion;
<br />
<br />THENCE leaving Ridgewood Street and the PLACE OF BEGINNING with the common
<br />occupied southwest line of the Witte remaining portion and the northeast line of the John Cox
<br />9.5 acre tract, as shown on that plat numbered 24396-98-c dated May 27, 1998 as prepared for
<br />CalTex Holdings, Inc. by Bym & Associates, Inc. of San Marcos, Texas, as fenced and used
<br />upon the ground, the following three courses:

<br />1. N. 450 50' 30" W 79.55 feet to a 26" cedar tree for an angle point in fence,
<br />
<br />2. N 450 49' 10" W 303.14 feet to a 15" elm tree for an angle point in fence, and
<br />
<br />3. N 470 22' 29" W 149.50 feet to a 6" cedar comer post in the occupied southeast
<br />line of Lot 1, Block I, Hughson Heights as recorded in Volume 1, Page 59 of the
<br />Hays County Plat Records for the common occupied west comer of the Witte
<br />remaining portion and the north comer of the John Cox 9.5 acre tract;

<br />THENCE leaving the John Cox 9.5 acre tract with the common northwest line of the Witte
<br />remaining portion and the southeast line of Lot 1, Block I, Hughson Heights, N 430 32' 18" E
<br />342.67 feet to a cotton gin spindle set for the common east corner of Lot 1 and the south corner
<br />of Lot 2, Block I, Hughson Heights;

<br />THENCE leaving Lot 1, Block I, Hughson Heights with the common northwest line of the Witte
<br />remaining portion and the southeast line of Lot 2 and 3, Block I, Hughson Heights, N 430 02'
<br />20" E 192.34 feet to a V2" iron rod set;
<br />
<br />THENCE with the common northwest line of the Witte remaining portion and the southeast line
<br />of Lot 3, Block I, Hughson Heights, N 530 22' 21" E 23.16 feet to a lh" iron rod found for the
<br />common east corner of Lot 3 and the south corner of Lot 4-A, Block I, Hughson Heights as
<br />recorded in Volume 6, page 237 of the Hays County Plat Records;
