M. Veramendi League No. One, in <br />the City of San Marcos, Hays County, Texas, being a part of the remnant portion <br />of a 7,63 acre tract of land (called Runway No. One) conveyed to the City of San <br />Marcos, Texas, by instrument recorded in Volume 163, Page 426, of the Deed <br />Records of Hays County, Texas, and said 0.629 acre tract being more particularly <br />described and shown in Exhibit "A" and Exhibit "B 1I attached hereto and <br />incorporated herein for all purposes. <br /> <br />GRANTOR, for the CONSIDERATIO~ paid to GRANTOR, hereby grants, sells, and <br />conveys to GRANTEE, its successors and assigns, a roadway easement for the purpose of <br />access, ingress and egress, and placing or causing to be placed, constructed, operated, repaired, <br />maintained, rebuilt, replaced, relocated and removed structures or improvements reasonably <br />necessary as a driveway and roadway upon, over and across the PROPERTY. <br /> <br />Notwithstanding any term or provision of this Roadway Easement, the Grantee hereby <br />contracts, covenants and agrees that: (1) Grantee shall execute and deliver to Grantor a good and <br />legally sufficient Release of this Roadway Easement upon Grantor dedicating the public right-of- <br />way shown on Exhibit "B" hereto as "Proposed 70' ROW"; and (2) that this Roadway Easement <br />shall automatically expire and terminate upon Grantor dedicating to the public the public right- <br />of-way shown on Exhibit "B" hereto as "Proposed 70' ROW". <br /> <br />Roadway Easement <br /> <br />1 <br /> <br />City of San Marcos <br />
