" c:: : ';~ ::1 :.- ~ < c..:>~ ORDINANCE 1999--..1.01 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING ARTICLE 2, MASTER PLAN, OF CHAPTER 102, PLANNING, OF THE CITY CODE TO AMEND THE SAN MARCOS HORIZONS CITY MASTER PLAN ADOPTED IN SECTION 102.026 BY ADOPTING A NEW CHAPTER 4, ANNEXATION; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. RECITALS: 1. Section 102.026 of the City Code adopts the San Marcos Horizons City Master Plan as the master plan for the physical development of the City. 2. The Director of Planning and Development Services has prepared a revised and updated Chapter 4, Annexation, ofthe master plan. 3. The Planning and Zoning Commission has conducted a public hearing on this revised Chapter 4 on November 9, 1999, and has voted to recommend the adoption of the revised Chapter 4 by the City Council. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The San Marcos Horizons City Master Plan adopted in Section 102.026 of the City Code is amended by the adoption of the revised Chapter 4, Annexation, in the form attached to this ordinance in place of the Chapter 4 previously contained in the master plan. SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 4. Any person violating any provision of this ordinance commits a misdemeanor and is subj ect to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 5. This Ordinance will take effect 10 days after the date of its final passage, and the City Secretary will publish notice of its adoption in a newspaper of general circulation in the City.
