ORDINANCE NO. 2003 - :1.3 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS DEDICATING A TRACT OF REAL <br />PROPERTY FOR PUBLIC STREET PURPOSES AS AN <br />EXTENSION OF PROGRESS STREET; AND INCLUDING <br />PROCEDURAL PROVISIONS. <br /> <br />122. <br /> <br /> o <br /> <br />RECITALS: <br /> <br /> 1. The Plam~ing m~d Zoning Commission has recommended that the City Council formally <br />dedicate the tract of real property described as "To be dedicated" on the map attached to this <br />ordinance (the "Proposed Street") for public street purposes as m~ extension of Progress Street. <br /> <br /> 2. The City Council wishes to dedicate the Proposed Street for public street purposes as an <br />extension of Progress Street. <br /> <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br /> SECTION 1. The Proposed Street is hereby dedicated for public street purposes as an <br />extension of Progress Street. <br /> <br /> SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in full force if they can be given effect without the invalid portion. <br /> <br /> SECTION 3. AIl ordinances and resolutions or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br /> <br /> SECTION 4. This Ordinance will take effect ten days after the date of its final passage, and <br />the City Secretary will publish notice of its adoption in a newspaper of general circulation in the <br />City. <br /> <br />PASSED AND APPROVED on first reading February 10, 2003. <br /> <br />PASSED AND APPROVED ON second reading February 24, 2003. <br /> <br />PASSED, APPROVED AND ADOPTED l~larch 3, 2003. <br /> <br /> Robert B.
