<br />ORDINANCE NO. <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AUTHORIZING THE ISSUANCE AND SALE OF CITY OF SAN <br />MARCOS, TEXAS, WATERWORKS AND SEWER SYSTEM REVENUE BONDS, <br />SERIES 1998, IN THE AGGREGATE PRINCIPAL AMOUNT OF $14,800,000; <br />PRESCRIBING THE FORM OF SAID BONDS; PROVIDING FOR mE <br />SECURITY FOR AND PAYMENT OF SAID BONDS; AWARDING THE SALE <br />THEREOF; APPROVING THE OFFICIAL STATEMENT; ENACTING omER <br />PROVISIONS RELATING TO THE SUBJECT; AND DECLARING AN <br />EMERGENCY <br /> <br />WHEREAS, this City Council (the "City Council"), by resolution adopted on December 8, 1997, <br />as the result of circumstances described in such resolution, ratified a first publication and directed a second <br />publication of notice of the intention of the City of San Marcos, Texas (the "City") to issue not to exceed <br />$14,800,000 waterworks and sewer system revenue bonds of the City for the purposes set forth in such <br />notice; <br /> <br />WHEREAS, such notice was published in the manner and to the extent required by law; <br /> <br />WHEREAS, there has not been filed with the City Secretary or any other office of the City a <br />petition protesting the issuance of such revenue bonds and requesting an election on same; and <br /> <br />WHEREAS, it is affirmatively found and determined that the City is authorized to proceed with <br />the issuan~e and sale of such revenue bonds as authorized by the laws of the State of Texas, including, <br />particularly, Tex. Rev. Civ. Stat. Ann. arts. 2368a and 1111, et seq.; Now, Therefore <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS: <br /> <br />ARTICLE I <br /> <br />DEFINITIONS AND OTHER PRELIMINARY MATTERS <br /> <br />Section 1.01. Definitions. <br /> <br />Unless otherwise expressly provided or unless the context clearly requires otherwise, in this <br />Ordinance the following terms shall have the meanings specified below: <br /> <br />"Additional Parity Obligations" means those obligations the City reserves the right to issue on a <br />parity with the Bonds, herein authorized in accordance with the terms and conditions prescribed in Section <br />9.01 hereof. <br /> <br />"Bond" means any of the Bonds. <br /> <br />"Bonds" means the City's bonds entitled "City of San Marcos, Texas, Waterworks and Sewer <br />System Revenue Bonds, Series 1998" authorized to be issued by Section 3.01 of this Ordinance. <br /> <br />"Closing Date" means the date of the initial delivery of and payment for the Bonds. <br /> <br />R:\SANMARIWWSS.98\DOCS\ORDNCE <br />
