<br />12.2 It is specifically understood and agreed that nothing contained in this lease shall be <br />construed as a granting or authorizing the granting of a right to conduct an aeronautical <br />activity which is discriminatory, and Lessee specifically agrees to operate a <br />non-discriminatory operation. Lessee, his agents and employees, will not discriminate in any <br />manner prohibited by Federal Aviation Regulations. Lessee further agrees to comply with <br />such enforcement procedures as might be required by the United States of America. <br /> <br />12.3 Lessor reserves the right to take any action it considers necessary to protect the aerial <br />approaches of the Airport against obstructions; and to limit the Lessee from erecting or <br />permitting to be erected any building or structure on the Airport and on the Leased Premises <br />that would limit the usefulness of the Airport or that would constitute a hazard to aircraft. <br /> <br />12.4 Lessor reserves the right to further develop the Airport as it sees fit regardless of the desires <br />of the Lessee, and without any hindrance or interference from the Lessee. Lessor expressly <br />reserves the right to grant leases and privileges to other individuals with respect to the <br />Airport facility, even though the purposes for which these leases are given are the same and <br />duplicate those contained in this Lease. If the development of the Airport requires the <br />relocation of Lessee-owned facilities, the Lessor agrees to provide a location comparable to <br />that provided to other private lessees at the time of the relocation without any unreasonable <br />interruption to the Lessee's activities, and agrees to relocate all Lessee-owned buildings, or <br />provide similar facilities for the Lessee at no cost to the Lessee, except that Lessor shall not <br />be required to pay more than the wholesale cost of foundation materials. <br /> <br />12.5 This Lease shall be subject to and in conformance with all City, State and Federal <br />ordinances, statutes and regulations. <br /> <br />12.6 The Lessee, for itself, its personal representatives, successors in interest, and assigns, as <br />part of the lease consideration, covenants and agrees as a covenant running with the land <br />that: (1) no person on the grounds of sex, race, creed, color, or national origin shall be <br />excluded from participation in, denied the benefits of, or be otherwise subjected to <br />discrimination in the use of the Leased Premises; (2) that in the construction of any <br />improvements on, over, or under the Leased Premises and the furnishing of services, no <br />person on the grounds of sex, race, creed, color, or national origin shall be excluded from <br />participation in, denied the benefits of, or otherwise be subjected to discrimination; (3) that <br />the Lessee shall use the premises in compliance with all other requirements imposed by or <br />pursuant to 49 CFR Part 21, Nondiscrimination in Federally Assisted Programs of the <br />Department of Transportation, as amended; and (4) that pursuant to the Americans with <br />Disabilities Act, no qualified individual with a disability will be discriminated against in <br />employment by the Lessee. <br /> <br />12.7 The Lessee assures that it will undertake an affirmative action program as required by 14 <br />CFR Part 152, Subpart E, to ensure that no person shall on the grounds of race, creed, <br />color, national origin, or sex be excluded from participating in any employment activities <br />covered in 14 CFR Part 152, Subpart E. The Lessee assures that no person shall be <br />excluded on these grounds from participating in or receiving the services or benefits of any <br />program or activity covered by this subpart. The Lessee assures that it will require that its <br />covered suborganizations provide assurances to the Lessee that they similarly will undertake <br />affirmative action programs and that they will require assurances from their suborganizations, <br />as required by 14CFR Part 152, Subpart E, to the same effect. <br /> <br />9 <br />
