<br />Section 2: Term <br /> <br />A. Employee agrees to remain in the exclusive employ of Employer during the term of this <br />agreement, and agrees not to become employed by any other employer until said termination as <br />hereinafter provided, except as provided in Section 10 hereof. <br /> <br />B. In the event vvTitten notice is not given by either party to this agreement to the other thirty <br />(30) days prior to the termination as hereinafter provided, this agreement shall be extended on the <br />same terms and conditions as herein provided, annually, without further action. <br /> <br />C. Nothing in this agreement shall prevent, limit or otherwise interfere with the right of the City <br />Council to terminate the services of Employee at any time, subject only to the provisions set <br />forth in this agreement. <br /> <br />D. Nothing in this agreement shall prevent, limit or othenvise interfere with the right of the <br />Employee to resign at any time from this position with Employer, subject only to the provisions <br />set forth in this agreement. <br /> <br />Section 3: Suspension <br /> <br />Employer may suspend the Employee with full pay and benefits at any time during the term of <br />this agreement, but only if <br /> <br />(1) a majority of the City Council and Employee agree, or <br />(2) a majority of the City Council votes to suspend Employee for cause provided, <br />however, that Employee shall have been given written notice setting forth any charges at least 10 <br />days prior to such action by the City Council members bringing such charges. At the request of <br />the Employee, the City Council shall hold a public hearing on said charges prior to a vote to <br />suspend Employee. <br /> <br />Section 4: Termination and Severance Pay <br /> <br />A. In the event Employee is terminated by the City Council during the term of this agreement <br />and during such time that Employee is willing and able to perform the duties under this <br />agreement, then in that event Employer agrees to pay Employee a lump sum cash payment equal <br />to 6 months aggregate salary, benefits, and deferred compensation. Employee shall also be <br />compensated for all earned vacation, holidays, and other accrued benefits to date; and up to 60 <br />days sick leave will be paid upon termination. <br /> <br />2 <br />
