A general and special election is ordered to be held by the City of San <br />Marcos (City), at the polling places and election precincts within the corporate limits of the <br />City, as designated in this ordinance, on the 2nd day of May, 1998, from the hours of 7:00 <br />a.m. to 7:00 p.m., at which election there shall be elected by the qualified voters of the <br />City, a Mayor for a term of two years, a City Council Member for Place 1, and a City <br />Council M~mber for Place 2, for terms of three years each and at which election there shall <br />be submitted to the qualified voters of the City, ballot propositions for proposed <br />amendments to the City Charter, in accordance with applicable provisions of the City <br />Charter and State law. <br /> <br />SECTION 2. The following measures will be submitted to the qualified voters of the <br />City at the election, in accordance with Section 9.004 of the Texas Local Government Code <br />and Section 12.02 of the San Marcos City Charter and other applicable laws: <br /> <br />MEASURE NO.1 <br /> <br />SHALL SECTION 1.03 OF THE CITY CHARTER BE ADDED TO READ AS <br />FOLLOWS: <br /> <br />Sec. 1.03. Statement of goals. <br /> <br />The goals of the city government are to create a strong community, <br />foster a high quality of life, promote neighborhood integrity, support sound <br />community and economic development, conserve and protect the city's <br />natural resources and the environment, and safeguard the health, safety <br />and welfare of the city's residents. <br /> <br />MEASURE NO.2 <br /> <br />SHALL SECTION 2.02 OF THE CITY CHARTER BE AMENDED TO READ AS <br />FOLLOWS: <br /> <br />Sec. 2.02.. Eminent domain. <br /> <br />The city shall have the full power and right to exercise the power of <br />eminent domain when necessary or desirable to carry out any of the powers <br />conferred upon it by this Charter or by the constitution and laws of the State <br />of Texas. The city may exercise the power of eminent domain in any manner <br />authorized or permitted by the constitution and laws of this state, subject to <br />the right of the owner of the property taken to adequate compensation. The <br />power of eminent domain shall include the right of the city to take the fee in <br />land so condemned, and the right to condemn public property for such <br />purposes.
