<br />ARTICLE 12 <br />OTHER DUTIES AS SET FORTH IN THE CONSTRUCTION DOCUMENTS <br /> <br />12.1 Engineer will have such other duties and responsibilities and limitations of authority <br />as agreed to by Engineer in writing and as are set forth in the construction contract <br />documents for the Project. However in the event of conflict, dispute, or discrepancy <br />between the provisions of this Agreement and the construction contract documents, the <br />more restrictive and/or burdensome will govern and control. <br /> <br />ARTICLE 13 <br />BASIS OF COMPENSATION <br /> <br />13.1 The City will compensate the Engineer, in accordance with Article 4, Payments to <br />the Engineer, and the other terms and conditions of this Agreement, as follows: <br /> <br />13.2 The total fee to be paid to Engineer for Basic Services as described in Section 1.2 <br />will be $45,230.00. The total fee to be paid to Engineer for Basic Services as described <br />in Sections 1.3 and 1.4 will be negotiated upon Engineer's completion of Phase I services <br />and will be included in this Agreement by separate written amendment prior to Engineer <br />proceeding with any work included as Phase II or Phase III services. <br /> <br />13.3 Compensation for additional services of the Engineer, as described in Section 1.5, <br />shall be computed based on the Engineer's standard hourly rates: <br /> <br />Professional Engineer <br />Registered Professional Land Surveyor <br />Survey (2-man crew) <br />CADD Technician <br />Secretarial <br /> <br />$85.00 <br />$85.00 <br />$75.00 <br />$45.00 <br />$30.00 <br /> <br />This Agreement will be effective as of the day and year executed by the City. <br /> <br />U'~ j j)1( ~ <br />Larry/D.
