<br /> <br />QC <br />0-' <br />Q' <br /> <br />52 <br /> <br /> <br />ORDINANCE 1998--1L <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br />MAP OF THE CITY BY REZONING A 0.29 ACRE TRACT OF <br />PROPERTY LOCATED AT 1224 ALAMO STREET FROM "R- <br />1" SINGLE-FAMILY DWELLING DISTRICT (LOW DENSITY) <br />TO "P" PUBLIC AND INSTITUTIONAL DISTRICT; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING <br />FOR PENALTIES. <br /> <br />l.f\ <br />N <br /> <br />RECITALS: <br /> <br />1. On February 10, 1998, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "R-1" Single- <br />Family Dwelling District (Low Density) to "P" Public and Institutional District for a 0.29 acre <br />tract of property located at 1224 Alamo Street. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on February 10, 1998 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. <br /> <br />The City Council held a public hearing on the 16th <br />, 1998, regarding the request. <br /> <br />day of <br /> <br />March <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br />of the San Marcos City Code, is amended to rezone the following real property which is <br />presently zoned "R-1" Single-Family Dwelling District (Low Density) to "P" Public and <br />Institutional District: <br /> <br />Street address: <br /> <br />1224 Alamo Street <br /> <br />Size: 0.29 acre. <br /> <br />Legal description: Lot 4, Block 9, of the McNaughton Addition. <br /> <br />Deed or plat reference: Volume 55, page 397, Hays County Deed Records. <br /> <br />SECTION 2. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 3. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br />in a newspaper of general circulation in the City. This ordinance will take effect upon <br />publication of this notice. <br /> <br />PASSED, APPROVED AND ADOPTED this16tlday of March , 1998, <br />subject to reconsideration at the next regular City Council meeting scheduled for <br />March 23, 1998 <br />
