Box 1305 Boerne, Texas 78006 LETTER AGREEMENT Dem' Mr. Chapman: This letter shall selwe as an agreement between Chapman Engineering (the "Engineer"), P.O. Box 1305, Boerne, Texas 78006 and the City of San Marcos (the "City"), 630 East Hopkins, San Mm'cos, Texas 78666 for the Engineer's performance of professional services for Site Closure Activities and Final Site Closure Report for the City's petroleum storage tank cleamtp sites (LPST #92680) in accordance with the scope of work described in the letter from the Engineer to the City attached as Attaclunent A to this Agreement. The Engineer agrees to perform all services in accordance with the attached City of San Marcos Terms and Conditions for Professional Services Agreements (Attactnnent B). The City agrees to pay the Engineer a not-to-exceed amount of $30,824 for the performance of services, in accordance with the estimated costs stated in Attachment A. The City will pay the Engineer two-thirds of the total cost estimate one week before the Engineer's well plugging and abandomnent work commences. The City will pay the Engineer the remaining mnount due, based on an itemized invoice fi'om the Engineer, within 15 days of the Engineer's delivery to the City and TCEQ of the completed Final Site Closure Report. Please indicate your acceptance of this agreement by counter-signing below, and return one fully executed copy to the City Clerk's Office.
