Certain areas located within areas of special flood hazard established in section 39.021, <br />are designated as floodways. Since the floodway is an extremely hazardous area due to the <br />velocity of floodwaters that carry debris potential projectiles and have significant erosion <br />potential, the following provisions apply: <br />(1) Compliance with standards in section 39.043. <br />(2) Prohibition on encroachments, including fill new construction substantial <br />improvements and other developments with the regulry floodway unless it has <br />been demonstrated through hydrologic and hydraulic analyses performed in <br />accordance with standard engineering practice that the proposed encroachment <br />would not result in any increase in flood levels within the community duringL the <br />occurrence of the base flood discharge. <br />Sec. 39.046 Existin! Structures <br />(1) Structures and uses of structures which lawfully exist prior to the effective date of this <br />ordinance and which do not conform to this Article may be continued subject to the <br />following conditions: <br />(a) In floodway. Existing structures and uses within a floodway shall not be expanded <br />or enlarged unless the effect of proposed expansion or enlargement does not cause <br />an additional increase in floodway elevation during the occurrence of the base <br />flood discharge, as certified by a re istered professional engineer. <br />(b) Modifications to existing structure. Any repair, reconstruction or improvement of <br />an existing structure within a floodplain which constitutes substantial <br />improvement shall be undertaken only in full compliance with this Article and <br />the owner shall be required to obtain a floodplain permit before repair, <br />reconstruction or improvement shall begin. <br />Sec. 39.047. Critical Facilities. <br />Construction of new Critical Facilities shall be to the extent possible located outside the <br />limits of the SFHA, preferably outside the 0.2% annual chance floodplain Construction of new <br />Critical Facilities may be permissible within the SFHA if feasible alternative sites are <br />unavailable. Critical Facilities constructed within the SFHA shall have the lowest floor elevated <br />3.0 feet above the base flood elevation at the site. Flood proofing and sealing measures must be <br />taken to ensure that toxic substances will not be displaced by or released into floodwaters <br />Access routes elevated to or above the level of the base flood elevation shall be provided to all <br />Critical Facilities to the maximum extent possible. <br />24 <br />
