April 11, 2012 AGREEMENT FOR PRELIMINARY ENGINEERING SERVICES FOR RAILROAD APPROVAL Crossing: Public: State: Texas City: San Marcos M.P. 290.10 - Austin Sub Subdivision TXDOT No. 4476850 and 4955928 (Patton Street) Hays County Joe A. Garcia Manager, Industry & Public Projects Southern Texas and Portions of Western Texas Union Pacific Railroad P.O. Box 240730 San Antonio, TX 78224 -0730 Dear Mr. Garcia: Plans are being prepared to construct median and sign Improvements at the location referenced above. The proposed work Includes concrete medians In the center of the Patton Street R.O.W. on either side of both lines In connection with the project the City of San Marcos considers it necessary for the successful advancement of the project for your company to collaborate in the development of the project by performing the following: • Preliminary engineering and other related services for the design of a four- quadrant gate system for these crossings • Development of cost estimates • Review of the project's preliminary layouts • Submit current train and switching moves The City of San Marcos authorizes and agrees to reimburse the Railroad for its expenses and actual costs that are incurred for collaborating in the development of the project's preliminary engineering and other preliminary activities. The Railroad h s estimated that these preliminary engineering and other preliminary costs will be $ 30, 000 t' . Payment will be made within thirty (30) days from the City of San Marcos's receipt and approval of the Railroad's request for reimbursement. Railroad will refer to the City of San Marcos's Project Number 72040 and forward invoices to James C. Massaro, Senior Engineer, Capital Improvements. The project may require the Railroad to incur costs for force account activities. Please prepare the railroad force account cost estimate for work activities to be provided by your company, and submit them at your earliest convenience so that they may be attached to the railroad- generated Construction & Maintenance (C &M) agreement.
