April 11, 2012 <br />AGREEMENT FOR PRELIMINARY ENGINEERING SERVICES <br />FOR RAILROAD APPROVAL <br />Crossing: Public: <br />State: Texas City: San Marcos <br />M.P. 290.10 - Austin Sub Subdivision <br />TXDOT No. 4476850 and 4955928 (Patton Street) <br />Hays County <br />Joe A. Garcia <br />Manager, Industry & Public Projects <br />Southern Texas and Portions of Western Texas <br />Union Pacific Railroad <br />P.O. Box 240730 <br />San Antonio, TX 78224 -0730 <br />Dear Mr. Garcia: <br />Plans are being prepared to construct median and sign Improvements at the location <br />referenced above. The proposed work Includes concrete medians In the center of the Patton <br />Street R.O.W. on either side of both lines In connection with the project the City of San <br />Marcos considers it necessary for the successful advancement of the project for your company to <br />collaborate in the development of the project by performing the following: <br />• Preliminary engineering and other related services for the design of a four- quadrant gate <br />system for these crossings <br />• Development of cost estimates <br />• Review of the project's preliminary layouts <br />• Submit current train and switching moves <br />The City of San Marcos authorizes and agrees to reimburse the Railroad for its expenses and <br />actual costs that are incurred for collaborating in the development of the project's preliminary <br />engineering and other preliminary activities. The Railroad h s estimated that these preliminary <br />engineering and other preliminary costs will be $ 30, 000 t' . Payment will be made within <br />thirty (30) days from the City of San Marcos's receipt and approval of the Railroad's request for <br />reimbursement. Railroad will refer to the City of San Marcos's Project Number 72040 and <br />forward invoices to James C. Massaro, Senior Engineer, Capital Improvements. <br />The project may require the Railroad to incur costs for force account activities. Please prepare <br />the railroad force account cost estimate for work activities to be provided by your company, and <br />submit them at your earliest convenience so that they may be attached to the railroad- generated <br />Construction & Maintenance (C &M) agreement. <br />
