<br />I <br /> <br />~YI/ <br /> <br />I <br /> <br />I <br /> <br />PROFESSIONAL ENGINEERING SERVICES AGREEMENT <br /> <br />This Agreement is made this the 18th day of October, 2006, between the City of San <br />Marcos, Te~as ("City"), 630 East Hopkins, San Marcos, Texas 78666 and Kellogg Brown & <br />RootX~~8g1n~er"), 505 E. Huntland Drive, Suite 100, Austin, Texas 78752 for the provision of <br />services in connection with the FM3407 Wonder World Drive Extension Project (the "Project"). <br /> <br />The City and the Engineer agree as follows: <br /> <br />ARTICLE 1 <br />ENGINEER'S SERVICES AND RESPONSIBILITIES <br /> <br />1.1 STANDARDS OF PERFORMANCE <br /> <br />1.1.1 Engineer will be responsible for the proper, accurate and adequate design and <br />preparation of plans and specifications and other construction contract documents and for <br />construction administration for the Project. The Project consists of the construction of FM <br />3407 (Wonder World Drive) from FM 2439 (Hunter Road) westward to intersect with RM 12, <br />and an expansion of FM 3407 to 6-lanes from the terminus of the FM 3407 railroad overpass to <br />FM 2439 (Hunter Road), in San Marcos. The Project also will consist of extending Craddock <br />Road from its current terminus at Bishop Street to FM 3407. In general, the Project involves: <br /> <br />(a) <br /> <br />the construction of a 4-lane divided section with grass medians, 4-lane divided <br />section with flush median, and 4-lane divided bridge approximately 2520 feet in <br />length; <br />curb and gutter with storm sewer system and water quality ponds hazardous <br />material chambers; <br />proposed pavement design; <br />drainage studies and drainage analysis/design; <br />traffic control; <br />signing, striping and delineation; <br />environmental permitting; <br />geotechnical investigations; <br />water quality analysis; and <br />subsurface utility investigations. <br /> <br />(b) <br /> <br />(c) <br />(d) <br />(e) <br />(f) <br />(g) <br />(h) <br />(i) <br />(j) <br /> <br />1.1.2 The Engineer understands that this Project has been approved by the Texas Department <br />of Transportation ("TxDOT") as a pass-through toll project and funding for the construction of <br />this Project is being provided by TxDOT. The Engineer will perform all of its services so that <br />the Project will proceed in accordance with the applicable requirements of the Pass-Through Toll <br />Agreement and the Local Transportation Project Advance Funding Agreement between the City <br />of San Marcos and TxDOT. The Project will comply with all applicable federal requirements <br />including those cited in 23 CFR Part 172 and those relating to participation by disadvantaged <br />business enterprises, the Americans with Disabilities Act, and environmental matters. <br /> <br />1 <br />
