Corporation to dedicate a 60' wide right-of-way for construction of a road connecting the 7.82 acre tract to the IH-35 access road, with the road design and construction costs to be shar~d evenly between the City and McCoy Corporation. SECTION 2. The City Manager, Dan O'Leary, is authorized to execute all documents necessary to effectuate this exchange on behalf of the City. SECTION 3. The 17.688 acre and 7.82 acre tracts of property being acquired by the City through this exchange may be sold and/or traded by the City, or devoted to uses other than parkland uses, but the proceeds of any such sale, trade, or change in use of the acquired property shall be used only to acquire more suitable parkland and/or recreation facilities. SECTION 4. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in full force if they can be given effect without the invalid portion. SECTION 5. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 6. This Ordinance will take effect 10 days after the date of its final passage, and the City Clerk will publish notice of its adoption in a newspaper of general circulation in the City.
