FOR A SPORTS <br />VEHICLE TRACK AND FACILITY IN THE 3100 BLOCK OF <br />HARRIS HILL ROAD; AUTHORIZING THE CITY MANAGER <br />TO EXECUTE THE AGREEMENT; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />f.....) ,..-:1'~ <br /> <br />?-: ~~-q <br />uovl <br />>- <br />i-- " <br /> <br />RECITALS: <br /> <br />1. Harris Hill Road, Inc. (the "Developer") is the owner ofthe 150 acre, more or less, tract of <br />land in Hays County, Texas (the "Property"), described in Exhibit A to the agreement attached to this <br />resolution. <br /> <br />2. The Developer has submitted an application for approval of a development agreement to <br />the City for development of a sports vehicle track and facility on the Property, which is located in the <br />extraterritorial jurisdiction of the City. <br /> <br />3. Chapter 2, Article 2 ofthe City Land Development Code (the "LDC") provides for the City <br />to enter into a development agreement with the owner of property in the extraterritorial jurisdiction <br />of the City in circumstances where only limited, interim development of the Property is to occur. <br /> <br />4. The City Council held a public hearing on September 19 <br />Developer's application. <br /> <br />, 2006 regarding the <br /> <br />5. All requirements of Chapter 1, Development Procedures, of the LDC pertaining to <br />approval of a Development Agreement have been met. <br /> <br />6. The City Council hereby finds and determines that the adoption of the following <br />resolution is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />P ART 1. The terms and conditions of the attached Development Agreement with Harris Hill <br />Road, Inc. for a Sports Vehicle Track and Facility are approved. <br /> <br />PART 2. The City Manager, Dan O'Leary, is authorized to execute the attached agreement <br />on behalf of the City. <br /> <br />P ART 3. This Resolution is in full force and effect immediately from and after its adoption. <br /> <br />ADOPTED on September 19, 2006. <br />
