opposed, Council Members Scott and Thomaides, to amend Section 2.273 removing the <br />language "but not limited to." The motion carried. MOTION TO AMEND: Upon a motion <br />made by Council Member Porterfield and a second by Council Member Becak, the City Council <br />voted seven (7) for and none (0) opposed, to amend Section 2.271 to state that voting members <br />must be customers of the city's water, wastewater, or electric utility systems and must reside <br />within the city limits. The motion carried unanimously. MOTION TO AMEND: Upon a <br />motion made by Council Member Thomason and a second by Council Member Becak, the City <br />Council voted six (6) for and one (1) opposed, Council Member Porterfield to amend Section <br />2.273 to add the language, "...and future water sources." The motion carried. MAIN <br />MOTION: the City Council voted seven (7) for and none (0) opposed, to approve Ordinance <br />2012 -31, as amended. The motion carried unanimously. Council provided direction for the <br />board to provide feedback regarding additional items they would like to look at after conducting <br />two meetings. <br />(16) MOTION: Upon a motion made by Council Member Scott and a second by Council <br />Member Prather, MOTION TO POSTPONE: Upon a motion made by Council Member <br />Thomason and a second by Council Member Becak, the City Council voted seven (7) for and <br />none (0) opposed, to postpone Resolution 2012 -62R, as previously captioned, until the next <br />regular meeting on June 19, 2012. The motion carried unanimously. <br />Public Hearings <br />17. Receive a Staff Presentation and hold a Public hearing to receive comments for or <br />against Ordinance 2012 -32, granting to the Pedernales Electric Cooperative, Inc., its legal <br />representatives, successors and assigns, certain rights -of -way privileges and a nonexclusive <br />franchise to construct, maintain, operate and use a transmission and distribution system <br />within a portion of the city of San Marcos to provide electric utilitv service; setting forth <br />the terms and conditions of the franchise; providing a process for resolving violations of the <br />ordinance; providing a savings clause and an effective date; and consider approval of <br />Ordinance 2012 -32 on the first of three readings. <br />Non Consent Agenda <br />Mayor Guerrero opened the Public Hearing at approximately 7:52 p.m. <br />There being no comment Mayor Guerrero closed the Public Hearing at approximately 7:52 p.m. <br />MOTION: Upon a motion made by Council Member Scott and a second by Council Member <br />Becak, the City Council voted seven (7) for and none (0) opposed, to approve Ordinance 2012- <br />32, as previously captioned. The motion carried unanimously. <br />18. Receive a Staff Presentation and hold a Public Hearing to receive comments for or <br />against Resolution 2012 -63R, approving a Conditional Use Permit variance under Section <br />4.3.4.2 of the Land Development Code to allow Pappa Pasta's Restaurant to serve alcohol <br />for on -site consumption at 2550 Hunter Road which location is less than 300 feet from <br />Doris Miller Junior High School; and declaring an effective date; and consider approval of <br />Resolution 2012 -63R. <br />
