<br />I <br /> <br />I <br /> <br />I <br /> <br />RESOLUTION NO. 2006- 140 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING AMENDMENT NO. 1 TO <br />THE DEVELOPMENT INCENTIVE AGREEMENT BETWEEN <br />THE CITY AND JSA RETAIL, LLC, FOR A COMMERCIAL <br />DEVELOPMENT AT 1705 IH-35 SOUTH; AUTHORIZING THE <br />CITY MANAGER TO EXECUTE THE AGREEMENT; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City Council adopted a resolution on March 21, 2006 approving a Development <br />Incentive Agreement (the "Agreement") with JSA Retail, LLC ("JSA Retail") for a commercial <br />development at 1705 IH-35 South. <br /> <br />2. Mr. Jaime Ayala, as principal for JSA Retail, has requested an extension of the deadline <br />for completion of the construction called for under the Agreement. <br /> <br />3. The City Council wishes to approve Amendment No.1 to the Agreement to grant the <br />requested extension in the construction completion deadline. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The terms and conditions of the attached Amendment No.1 to Development <br />Incentive Agreement with JSA Retail, LLC for a commercial development at 1705 IH-35 South are <br />approved. <br /> <br />PART 2. The City Manager, Dan O'Leary, is authorized to execute this Amendment. <br /> <br />PART 3.
