I I I RESOLUTION 2006- 1-)) R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AWARDING A DESIGN-BUILD CONSTRUCTION CONTRACT TO FLINTCO, INC. FOR THE SAN MARCOS CONFERENCE CENTER PROJECT; AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT DOCUMENTS ON BEHALF OF THE CITY AND DECLARING AN EFFECTIVE DATE. RECIT ALS: 1. The City wishes to hire a design-build contractor for the construction of the San Marcos Conference Center in accordance with the process mandated in Section 271.119 of the Texas Local Government Code. 2. The City selected design-build contractor, Flintco, Inc. has been approved by John Q. Hammons as required under the City's Master Development Agreement with Mr. Hammons. 3. Flintco has submitted to the City an estimated Guaranteed Maximum Price (the "GMP"). However, the actual GMP which will be submitted by Flintco, Inc. will be subject to negotiation and acceptance by the City in accordance with State law and the Request for Proposals. 4. At this time, the contract award engages Flintco, Inc. to perform preconstruction services and to prepare the actual GMP for City consideration. 5. Under the proposed contract award, Flintco, Inc. will be authorized to proceed to construction under the contract only if the City Council accepts the GMP as finally negotiated and authorizes the City Manger to issue a Notice to Proceed. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS PART 1. The award of a design-build construction contract to Flintco, Inc., for the San Marcos Conference Center Project is approved. PART 2. The City Manager, Dan O'Leary, is authorized to execute the contract documents on behalf of the City. PART 3. Flintco, Inc. will be authorized to proceed to construction under the contract only if the City Council accepts the GMP as finally negotiated and authorizes the City Manger to issue a Notice to Proceed.
