I I I 113 RESOLUTION 2006-_118 R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING AN EMERGENCY CONSTRUCTION CONTRACT WITH TEXAS-STERLING CONSTRUCTION, INC. FOR ADDITIONAL WORK ON THE RIO VISTA DAM MAINTENANCE AND IMPROVEMENTS PROJECT; AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT DOCUMENTS ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. In the course of construction of the Rio Vista Dam Maintenance and Improvements Project with Kellogg Brown and Root Services, Inc. ("KBR") and Greenway Enterpnses, Inc. ("Greenway") it was determined that additional work on the right bank portion of the Project was necessary to stabilize the area and complete the project. 2. KBR was not interested in prosecuting the work and Greenway was not able to prosecute the work. 3. In order to complete the project in as expeditiously a manner as possible, the City engaged Texas-Sterling Construction, Inc. to complete the additional work due to its immediate availability and experience in the additional work required. 4. The City Council finds and determines that it was necessary to enter into this construction contract on an emergency basis without formal competitive bidding in order to preserve and protect the public health and safety of the City's residents. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The award of an emergency contract to Texas Sterling Construction, Inc. for the additional work on the Rio Vista Dam Maintenance and Improvements Project in the amount of $68, 152.00 is approved. PART 2. The City Manager, Dan O'Leary, is authorized to execute the contract documents on behalf of the City. PART 3. after its passage. This Resolution shall be in full force and effect immediately from and ADOPTED this the 2nd day of August 2006.
