<br />Proposed Land Uses <br /> <br />Property located within the proposed Zone will be developed as <br />commercial, industrial, and public facility uses. <br /> <br />A preliminary site plan depicting the proposed uses of the property <br />within the Zone is attached as Exhibit "G", <br /> <br />Proposed Property Exchange <br /> <br />The design of the Project as shown on the preliminary site plan will <br />require conveyances by the City and JQH to each other of portions of <br />their respective portions of the Project Site so that each party will be <br />constructing its portion of the Project on land that it owns. Generally, <br />the City presently owns a five acre portion of the property at the back <br />of the Zone relative to IH-35, and JQH owns the remaining ten acre <br />portion of the property at the front of the Zone relative to IH-35. The <br />exact areas to be conveyed are being finalized as the site plan <br />preparation progresses. In accordance with Texas Local Government <br />Code Section 272.001 (b)(6), the City intends to accomplish these <br />conveyances with JQH after obtaining an appraisal indicating that the <br />property being conveyed by JQH to the City is equal to or greater in <br />fair market value than the being conveyed by the City to JQH. <br /> <br />Proposed Changes of Zoning Ordinances <br /> <br />All development and construction in the Zone will be done in <br />conformance with all applicable development and construction <br />regulations of the City of San Marcos, subject to variances granted <br />under the City Land Development Code, and waivers provided for in <br />the City's Master Development Agreement with the developer of the <br />hotel project on the project site. There are no proposed changes of <br />any City development or construction regulations for the Zone. <br /> <br />4 <br />
