ORDiNANCE 2003- 16 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONINNG MAP OF THE CITY BY REZONING A 0.246 ACRE TRACT OF PROPERTY LOCATED AT 204 MILL STREET FROM "C" COMMERCIAL TO "R-I" SINGLE- FAMILY DWELLING DISTRICT (LOW DENSITY); INCLUDiNG PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. 151. RECITALS: 1. On December 10, 2002, the Planning and Zoning Commission of flxe City of San Marcos held a public hearing regarding a request to change the zoning from "C" Commercial District to "R-I" Single-Family Dwelling District (Low Density) for a 0.246 acm tract of property located at 204 Mill Street. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on December 10, 2002, consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Com~cil held a public hearing on the 24th day of 2003, regarding the request. March 4. Ail requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Couucil hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAiNED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the following real property which is presently zoned "C" Commercial District to "Rd" Siugle-Family Dwelling District (Low Density): Street address: 204 Mill Street. Size: 0.246 acres. Legal description: Northeast ½ of Lots 4 & 5 of the Millview Addition, a metes and bounds description of which is attached as Exhibit A. Deed or plat reference: Volume 112, page 59, Hays County Deed Records.
