RESOLUTION NO. 2012 - 80R <br />A RESOLUTION IN SUPPORT OF THE CITY OF SAN MARCOS <br />BECOMING THE DESIGNATED RECIPIENT FOR FEDERAL <br />TRANSIT ADMINISTRATION FUNDING FOR THE SAN MARCOS <br />URBANIZED AREA, PURSUANT TO 49 U.S.C. SECTION 5307 (2) (A); <br />AUTHORIZING THE CITY MANAGER TO FILE <br />DOCUMENTATION IN SUPPORT OF THE CITY ACHIEVING <br />DESIGNATED RECIPIENT STATUS; AND DECLARING AN <br />EFFECTIVE DATE. <br />RECITALS: <br />1. The City of San Marcos has been designated as a new small urbanized area <br />pursuant to the 2010 U.S. Census results. <br />2. This designation will result in the City being eligible to receive direct Federal <br />Transit Administration (FTA) funding to support the operating, capital and planning costs <br />associated with the provision of public transit services, as of October 1, 2012. <br />3. The City has previously submitted documentation to the FTA, including a City <br />Council Resolution, Legal Opinion, and Certifications and Assurances to support the City's FTA <br />grantee status. <br />4. The submitted documentation for FTA grantee status confirmed the City's <br />willingness to comply with all federal and state provisions related to the expenditure of transit <br />funding. <br />5. The City of San Marcos desires to become the designated recipient for the San <br />Marcos Urbanized Area. <br />6. The City of San Marcos has the requisite legal, technical, and financial capability <br />to undertake and comply with FTA guidelines and procedures, and to fulfill its' responsibilities <br />as the "designated recipient ", including the legal authority to dispense federal transit funding <br />within the San Marcos Urbanized Area. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br />PART 1. The City Manager is authorized to execute and file all necessary <br />documentation and information to enable the City of San Marcos to become the designated <br />recipient for federal transit funding for the San Marcos Urbanized Area. <br />
