<br />I <br /> <br />I <br /> <br />I <br /> <br />21 . <br /> <br />RESOLUTION 2006- q s R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS FINDING THE CITY'S HOUSEHOLD HAZARDOUS WASTE <br />TRAILER TO BE SURPLUS AND OF NO VALUE TO THE CITY OF SAN <br />MARCOS; APPROVING AN AGREEMENT WITH THE LOWER <br />COLORADO RIVER AUTHORITY AUTHORIZING THE TRANSFER OF <br />THE TRAILER; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECIT ALS: <br /> <br />1. In September of 1998 Lakeway Municipal Utility District transferred title to a <br />household hazardous waste trailer to the City of San Marcos. <br /> <br />2. Capital Area Council of Governments ("CAPCOG") grant funding was used to <br />purchase the trailer originally and the trailer may only be used to conduct Household Hazardous <br />Waste Collection ("HHWC") programs per the CAPCOG grant requirements. <br /> <br />3. The City utilized the trailer in conducting the Central Texas Household Hazardous <br />Waste Regional Collection events for the past several years. <br /> <br />4. The City has since received a grant from CAPCOG to purchase a safety storage <br />building as a permanent facility for the collection and storage of household hazardous waste. <br /> <br />5, City staff has determined that this trailer is surplus and of no value to the City and <br />wishes to transfer the trailer to the Lower Colorado River Authority ("LCRA") for the purposes <br />set forth in the original CAPGOG grant. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The City Council finds and determines that the household hazardous waste <br />trailer is surplus and of no value to the City of San Marcos. <br /> <br />P ART 2. The attached letter agreement to transfer the household hazardous waste trailer <br />to LCRA is approved. <br /> <br />PART 3. The City Manager, Dan O'Leary, is authorized to execute the agreement on <br />behalf of the City. <br /> <br />P ART 4. This Resolution shall be in full force and effect immediately from and after its <br />passage. <br />
