RESOLUTION 2006- q s R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS FINDING THE CITY'S HOUSEHOLD HAZARDOUS WASTE TRAILER TO BE SURPLUS AND OF NO VALUE TO THE CITY OF SAN MARCOS; APPROVING AN AGREEMENT WITH THE LOWER COLORADO RIVER AUTHORITY AUTHORIZING THE TRANSFER OF THE TRAILER; AND DECLARING AN EFFECTIVE DATE. RECIT ALS: 1. In September of 1998 Lakeway Municipal Utility District transferred title to a household hazardous waste trailer to the City of San Marcos. 2. Capital Area Council of Governments ("CAPCOG") grant funding was used to purchase the trailer originally and the trailer may only be used to conduct Household Hazardous Waste Collection ("HHWC") programs per the CAPCOG grant requirements. 3. The City utilized the trailer in conducting the Central Texas Household Hazardous Waste Regional Collection events for the past several years. 4. The City has since received a grant from CAPCOG to purchase a safety storage building as a permanent facility for the collection and storage of household hazardous waste. 5, City staff has determined that this trailer is surplus and of no value to the City and wishes to transfer the trailer to the Lower Colorado River Authority ("LCRA") for the purposes set forth in the original CAPGOG grant. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The City Council finds and determines that the household hazardous waste trailer is surplus and of no value to the City of San Marcos. P ART 2. The attached letter agreement to transfer the household hazardous waste trailer to LCRA is approved. PART 3. The City Manager, Dan O'Leary, is authorized to execute the agreement on behalf of the City. P ART 4. This Resolution shall be in full force and effect immediately from and after its passage.
