Hopkins <br />San Marcos, Texas 78666 <br /> <br />Dear Mr. Mendoza: <br /> <br />I <br /> <br />Per discussions with Keith Helmers at the Capital Area Planning Council of Government <br />(CAP COG), the City of San Marcos has agreed to transfer the property known as the <br />Central Texas Household Hazardous Waste Trailer, hereinafter referred to as The Trailer, <br />to the Lower Colorado River Authority for use in community household hazardous waste <br />collection activities. It is the LCRA's intention to make the trailer available to all <br />communities within the CAP COG region for events that also include the collection and <br />recycling of exempt household hazardous wastes such as batteries, used oil, latex paint, <br />antifreeze, and computers. The Trailer will be used to store or transport only non- <br />hazardous wastes and exempt hazardous wastes (as defined by Texas law). LCRA will <br />make the trailer available on a "first-come-first-serve" basis, and communities will need <br />to schedule their use of the trailer with no less than 30 days notice to LCRA. <br />Communities that use the trailer will sign a "use agreement", which will include an <br />equipment and supply inventory provision, certification of user's insurance, and a "rules <br />and regulations" compliance provision. <br /> <br />The City of San Marcos agrees to transfer title to the trailer (and execute such <br />documentation as is necessary to do so) to the LCRA in good working condition and <br />certifies that the trailer has passed all state inspections and has any permits currently <br />required for the trailer to be utilized on state and federal roadways. The City of San <br />Marcos also affirms the trailer has not been used for the transport or storage of any <br />hazardous materials or hazardous waste other than non-hazardous and exempt hazardous <br />wastes (household hazardous waste), as defined by Texas law. After this transfer, the <br />LCRA will be responsible for maintaining these state inspections and required permits. <br />The parties will agree to execute all documentation necessary to effectuate this transfer. <br /> <br />I <br /> <br />Other property included in the transfer, which are considered part of The Trailer are: <br />1) Event tent <br />2) material transfer carts <br />3) Miscellaneous equipment (traffic cones, etc.) <br /> <br />POBOX 220 .
