<br />I <br /> <br />I <br /> <br />I <br /> <br />L <br /> <br />40. <br /> <br />RESOLUTION 2006 - 99 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING THREE GRANT APPLICATIONS FOR <br />REGIONAL SOLID WASTE PROGRAM GRANTS FROM THE CAPITAL <br />AREA COUNCIL OF GOVERNMENTS; RATIFYING THE SUBMISSION OF <br />THE GRANT APPLICATIONS TO CAPCOG; AUTHORIZING THE CITY <br />MANAGER TO ACT IN ALL MATTERS RELATED TO THESE <br />APPLICATIONS AND ANY SUBSEQUENT GRANT AGREEMENTS; <br />PLEDGING THAT IF ANY GRANT IS RECEIVED AS A RESULT OF THESE <br />APPLICATIONS THE CITY WILL COMPLY WITH THE GRANT <br />REQUIREMENTS OF THE CAPITAL AREA COUNCIL OF <br />GOVERNMENTS, THE TEXAS COMMISSION ON ENVIRONMENTAL <br />QUALITY AND THE STATE OF TEXAS AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The Capital Area Council of Governments ("CAPCOG") is directed by the Texas <br />Commission on Environmental Quality ("TCEQ") to administer solid waste grant funds for <br />implementation of CAP COG's adopted regional solid waste management plan <br /> <br />2. The City is qualified to apply for grant funds under the Request for Applications <br />process. <br /> <br />3. Due to the deadline for submission, City staff were unable to set the grant <br />applicatIon for consideration by City Council consideration prior to its submission. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. City Manager, Dan O'Leary is authorized to request grant funding under <br />CAPCOG's Request for Applications of the Regional Solid Waste Grants Program and to act on <br />behalf of the City of San Marcos in all matters related to the grant applications and any <br />subsequent grant contract and grant project that may occur. <br /> <br />PART 2. If any project is funded, the City will comply with the grant requirements <br />of CAPCOG, TCEQ and the State of Texas. <br /> <br />PART 3. The grant funds and any grant-funded equipment will be used only for the <br />purposes for which they are intended under the grant. <br /> <br />PART 4. The City's activities regarding any project resulting from these grant <br />applications will comply with and support the adopted regional and local solid waste <br />management plans adopted for the geographical area in which the activities are performed. <br /> <br />PART 5. The filing of the attached grant applications with CAPCOG for Regional <br />Solid Waste Grant funding is ratified. <br /> <br />PART 6. <br />after its passage. <br /> <br />This Resolution shall be in full force and effect immediately from and <br />
