Mayor Guerrero opened the public hearing at 7:39 p.m. Ed Theriot, ETR Development Consulting, Buda, TX, stated that they had coordinated with the neighborhood association and that they were ok with the change. He asked for Council's favorable consideration. There being no other comments, the Public Hearing was closed at 7:40 p.m. MOTION: Upon a motion made by Council Member Thomason and a second by Council Member Prather, the City Council voted seven (7) for and zero (0) opposed, to approve Ordinance 2012 -33, as previously captioned. The motion carried unanimously. Non - Consent Agenda 24. Consider approval of Ordinance 2012 -34, amended and restated, on first and final reading, authorizing the issuance of City of San Marcos, Texas General Obligation Refunding Bonds; approving an official statement, a paving agent /registrar agreement, a bond purchase agreement and an escrow agreement; establishing the procedures for selling and delivering one or more series of the bonds; and authorizing other matters relating to the bonds. MOTION: Upon a motion made by Council Member Prather and a second by Council Member Thomaides, the City Council voted seven (7) for and none (0) opposed, to approve Ordinance 2012 -34, as previously captioned. The motion carried unanimously. 25. Consider approval of Ordinance 2012 -35, on the first of two readings, adopting fees to be charged by the City for various city services; providing a savings clause; providing for the repeal of any conflicting Provisions; and providing an effective date MOTION: Upon a motion made by Council Member Thomason and a second by Council Member Scott, the City Council voted seven (7) for and none (0) opposed, to postpone Ordinance 2012 -35, as previously captioned, until July 26, 2012.
