Mayor Guerrero opened the public hearing at 7:39 p.m. <br />Ed Theriot, ETR Development Consulting, Buda, TX, stated that they had coordinated with the <br />neighborhood association and that they were ok with the change. He asked for Council's favorable <br />consideration. <br />There being no other comments, the Public Hearing was closed at 7:40 p.m. <br />MOTION: Upon a motion made by Council Member Thomason and a second by Council <br />Member Prather, the City Council voted seven (7) for and zero (0) opposed, to approve <br />Ordinance 2012 -33, as previously captioned. The motion carried unanimously. <br />Non - Consent Agenda <br />24. Consider approval of Ordinance 2012 -34, amended and restated, on first and final <br />reading, authorizing the issuance of City of San Marcos, Texas General Obligation <br />Refunding Bonds; approving an official statement, a paving agent /registrar agreement, a <br />bond purchase agreement and an escrow agreement; establishing the procedures for selling <br />and delivering one or more series of the bonds; and authorizing other matters relating to <br />the bonds. <br />MOTION: Upon a motion made by Council Member Prather and a second by Council Member <br />Thomaides, the City Council voted seven (7) for and none (0) opposed, to approve Ordinance <br />2012 -34, as previously captioned. The motion carried unanimously. <br />25. Consider approval of Ordinance 2012 -35, on the first of two readings, adopting fees to <br />be charged by the City for various city services; providing a savings clause; providing for <br />the repeal of any conflicting Provisions; and providing an effective date <br />MOTION: Upon a motion made by Council Member Thomason and a second by Council <br />Member Scott, the City Council voted seven (7) for and none (0) opposed, to postpone <br />Ordinance 2012 -35, as previously captioned, until July 26, 2012. The motion carried <br />unanimously. <br />26. Consider approval of Ordinance 2012 -36, on the first of two readings, amending the <br />City's 20112012 Budget to fund a payment in the amount of $4,465.00 to Texas Aviation <br />Partners for its collection of past due revenues as provided under an amendment to its <br />airport management agreement with the City; and providing an effective date <br />MOTION: Upon a motion made by Council Member Thomaides and a second by Council <br />Member Thomason, the City Council voted seven (7) for and none (0) opposed, to approve <br />Ordinance 2012 -36, as previously captioned. The motion carried unanimously. <br />27. Consider approval of Resolution 2012 -84R, awarding a construction contract to RGM <br />Constructors of Texas, LLC for the Downtown Reconstruction Phase I protect in the bid <br />amount of $10,214,848.12 contingent upon the bidder's timely submission of sufficient <br />
