RESOLUTION 2012 -73R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AWARDING A CONSTRUCTION CONTRACT TO <br />SMITH CONTRACTING COMPANY, INC. FOR THE RIVER <br />ROAD /RIVERSIDE DRIVE BICYCLE /PEDESTRIAN IMPROVEMENTS <br />PROJECT IN THE BID AMOUNT OF $224,899.68 CONTINGENT UPON <br />THE BIDDER'S TIMELY SUBMISSION OF SUFFICIENT BONDS AND <br />INSURANCE IN ACCORDANCE WITH THE CITY'S BID DOCUMENTS <br />FOR THE PROJECT AND CONTINGENT UPON THE TEXAS <br />DEPARTMENT OF TRANSPORTATION'S APPROVAL OF THE <br />CONTRACT AWARD; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE THE CONTRACT DOCUMENTS ON BEHALF OF THE CITY <br />AND DECLARING AN EFFECTIVE DATE. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS <br />PART 1. The award of a construction contract to Smith Contracting Company, Inc. for <br />the River Road/Riverside Drive Bicycle /Pedestrian Improvements Project (IFB 212 -056) in the <br />amount of $224,899.68 is approved contingent upon the bidder's timely submission of sufficient <br />bonds and insurance in accordance with the City's bid documents for the Project and contingent <br />upon the Texas Department of Transportation's approval of the contract award. <br />PART 2. The City Manager is authorized to execute the contract documents on behalf <br />of the City. <br />PART 3.
