(13) MOTION: Upon a motion made by Council Member Porterfield and a second by Council <br />Member Becak, the City Council voted five (5) for and none (0) opposed, two (2) absent, <br />Council Members Thomaides and Prather, to approve Resolution 2012 -88R, as previously <br />captioned. The motion carried. <br />(14) MOTION: Upon a motion made by Council Member Prather and a second by Council <br />Member Thomason, MOTION TO AMEND: Upon a motion made by Council Member <br />Porterfield and a second by Council Member Thomaides, the City Council voted six (6) for and <br />one (1) opposed, Council Member Scott, to amend to direct the City Manager and City Attorney <br />to alter the contract to state that should The Square Peg fail to operate as a restaurant, as opposed <br />to a bar, the agreement will be null and void. The motion carried. MAIN MOTION: the City <br />Council voted seven (7) for and none (0) opposed, to approve. The motion carried unanimously. <br />Non Consent Agenda <br />16.Reconsider Ordinance 2012 -33, amending the Planned Development District standards <br />for the Blanco Vista Subdivision Planned Development District, being approximately <br />432.5 acres of land out of the William Ward Survey No 3 and the J W William survey <br />and part of the Blanco Vista Subdivision (except Blanco Vista Phase 1 -2, Sections 1 and <br />2 and infrastructure and Blanco Vista Tract I Section A and School Tract Blanco <br />Vista, Tract C, Section A, and Trail Ridge Pass Church Subdivision) located at the <br />intersection of Blanco Vista Boulevard and Trail Rid 2e Pass, for the purpose of <br />changing the minimum front yard setbacks to allow a variety of housing products; <br />including procedural provisions; and providing an effective date <br />No Reconsideration <br />17.Consider approval of Ordinance 2012 -37, on the first of two readings, amending <br />Chapter 90, Article 4, Wreckers, of the San Marcos City Code to eliminate the wrecker <br />rotation system for police - authorized towing; eliminating the previously authorized <br />"show up fee" for non - consent towing; revising regulations authorizing the collection of <br />a "drop fee," including procedural provisions, and declaring an effective date <br />MOTION: Upon a motion made by Council Member Thomason and a second by Council <br />Member Porterfield, the City Council voted four (4) for, two (2) opposed, Council Member <br />Porterfield and Scott and one (1) absent, Council Member Thomaides, to approve Ordinance <br />2012 -37, as previously captioned.
