(13) MOTION: Upon a motion made by Council Member Porterfield and a second by Council Member Becak, the City Council voted five (5) for and none (0) opposed, two (2) absent, Council Members Thomaides and Prather, to approve Resolution 2012 -88R, as previously captioned. The motion carried. (14) MOTION: Upon a motion made by Council Member Prather and a second by Council Member Thomason, MOTION TO AMEND: Upon a motion made by Council Member Porterfield and a second by Council Member Thomaides, the City Council voted six (6) for and one (1) opposed, Council Member Scott, to amend to direct the City Manager and City Attorney to alter the contract to state that should The Square Peg fail to operate as a restaurant, as opposed to a bar, the agreement will be null and void.
