15.4 Severability Clause. If any provision, section, subsection, sentence, clause or phrase of <br />this ordinance is for any reason found unconstitutional, void or invalid or for any reason <br />unenforceable, the City and PEC intend that the remaining portions of this Ordinance <br />are not affected thereby. It being the intent of the City and PEC in accepting this <br />Ordinance that no portion hereof or provision or regulation contained herein shall <br />become inoperative or fail by reason of any unconstitutionality or invalidity of any other <br />portion, provision, or regulation, and to this end, all provisions of this Ordinance are <br />declared severable. <br />15.5 Captions. The use of captions or headings for the various sections of this ordinance are <br />for the convenience of the parties only and do not reflect the intent of the parties. This <br />Ordinance shall be construed and deemed to have been drafted by the combined efforts <br />of the City and PEC. <br />PART 2. <br />This Franchise will be in effect 30 days from and after its final passage by the City Council of San <br />Marcos (the "Effective Date "). PEC will have sixty (60) days after the date of adoption of this <br />ordinance to file its written acceptance with the City Clerk.
