WHEREAS, the entire text of this ordinance was published in a newspaper of general circulation in the City on May 27 , 2012; and WHEREAS, the City Council conducted a public hearing before the first reading of this ordinance on the proposed franchise on June 5 , 2012. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, THAT: PART 1. SECTION 1. Definitions. 1.1 For the purpose of this Ordinance the following terms, phrases, words and their derivations shall have the meanings given herein. When consistent with the context, and whenever the sense of the text requires: (1) words used in the present tense include the future tense, (2) words in the plural number include the singular number, (3) words in the singular number include the plural number, and (4) the use of any gender shall be applicable to all genders. The words "shall" and "will" are mandatory and the word "may" is permissive. Words not defined shall be given their common and ordinary meaning. 1.2 City means the City of San Marcos, Texas, a Home -rule municipal corporation in the State of Texas, and includes the territory that currently is or may in the future be included within the boundaries of the City of San Marcos. 1.3 City Manager means the City Manager of the City or the City Manager's authorized designee. 1.4 City Utility means any utility service provided by the City including, but not limited to electric, water, and /or sewer utility service. 1.5 Council means the governing body of the City of San Marcos. 1.6 Customer means any person or organization in the City, including the City, being billed for Electric Utility Service whether used by that person or organization, or by others. 1.7 Director of Finance means the Director of Finance of the City of San Marcos, or his designee. The term shall also mean the Director of Finance's successor in function. 1.8 Effective Date means that date specified in Parts 2 and 3 hereof. 2
